1. Definitions

For the purpose of these Terms:

• "GoKhoj", "We", "Us", or "Our" refers to GoKhoj and its operators.
• "Platform" refers to the GoKhoj website, applications, services, and related features.
• "User" refers to any individual accessing, browsing, or using the Platform.
• "Vendor" refers to any business, shopkeeper, seller, service provider, or entity listing products, services, or business information on the Platform.
• "Listing" refers to any shop profile, product, service, advertisement, image, description, or information published on the Platform.
• "Subscription Services" refers to any paid promotional, featured, advertising, visibility enhancement, or boost services offered by GoKhoj.

2. Eligibility

By using GoKhoj, you represent and warrant that:

• You are at least 18 years of age or using the Platform under the supervision of a parent or legal guardian.
• You have the legal capacity to enter into binding agreements.
• Information provided by you is accurate, complete, and current.
• You will comply with all applicable laws and regulations.

3. Nature of Service

GoKhoj is a hyperlocal discovery platform.

GoKhoj helps users discover local shops, products, services, and businesses and enables direct communication between users and vendors.

GoKhoj is not:

• An e-commerce marketplace.
• A seller of products.
• A payment processor.
• A logistics provider.
• A delivery service.
• An agent of any Vendor.

GoKhoj does not:

• Sell products.
• Purchase products.
• Handle payments between users and vendors.
• Manage deliveries.
• Participate in commercial negotiations.

All transactions occur directly between Users and Vendors.

4. User Responsibilities

Users agree to:

• Use the Platform lawfully and responsibly.
• Verify product information before making purchasing decisions.
• Independently confirm pricing, availability, quality, authenticity, and specifications.
• Exercise caution before making payments or entering into agreements.

Users acknowledge that GoKhoj does not verify every listing and shall not be responsible for decisions made based on information displayed on the Platform.

5. Vendor Responsibilities

By creating a Vendor account or listing a business on GoKhoj, the Vendor agrees that:

• All information provided is accurate and lawful.
• They possess all necessary rights, licenses, and permissions required to conduct their business.
• They have the legal right to advertise, promote, and sell listed products or services.
• They will comply with all applicable laws and regulations.

Vendors are solely responsible for:

• Product quality
• Product descriptions
• Pricing
• Inventory availability
• Customer interactions
• Deliveries
• Warranties
• Returns
• Refunds
• Legal compliance

Vendors shall not publish:

• False information
• Misleading information
• Illegal products
• Counterfeit products
• Restricted products
• Offensive content
• Fraudulent content
• Content infringing intellectual property rights

6. Subscription Plans and Promotional Services

GoKhoj may offer:

• Free Business Listings
• Featured Shop Placements
• Featured Product Placements
• Advertisement Placements
• Boost Plans
• Promotional Campaigns
• Priority Visibility Services

The availability, duration, placement, scheduling, and visibility of promotional services shall be determined by GoKhoj.

GoKhoj reserves the right to modify, suspend, discontinue, introduce, or update any promotional service at its sole discretion.

7. Payment Terms

GoKhoj currently does not operate an online payment gateway.

Payments relating to:

• Boost Plans
• Advertisements
• Featured Listings
• Promotional Services

may be collected offline through arrangements determined by GoKhoj.

GoKhoj does not collect, store, process, or transmit payment authentication credentials through the Platform.

8. No Refund and Cancellation Policy

All payments made to GoKhoj are final.

No refunds, cancellations, reimbursements, credits, adjustments, or partial refunds shall be provided for:

• Boost Plans
• Featured Listings
• Advertisements
• Promotional Services
• Subscription Services

Once a service has been activated, scheduled, reserved, published, or confirmed, no cancellation or refund request shall be entertained.

Refunds shall not be provided due to:

• Low sales
• Low inquiries
• Low engagement
• Low visibility
• Business performance expectations not being met
• Vendor inactivity
• Change of business plans

except where required by applicable law.

9. Analytics and Interaction Tracking

GoKhoj may collect and display analytics information relating to platform activity, including:

• Product views
• Shop views
• WhatsApp clicks
• Instagram clicks
• Facebook clicks
• Phone number clicks
• General engagement metrics

Such analytics are provided for informational purposes only.

GoKhoj does not guarantee:

• Accuracy
• Completeness
• Continuous availability

of analytics data.

Users and Vendors agree that GoKhoj shall not be liable for business decisions made using such information.

10. Third-Party Platforms

The Platform may redirect users to third-party services including:

• WhatsApp
• Instagram
• Facebook
• Telephone calling services

GoKhoj is not responsible for:

• Availability of third-party platforms
• Service interruptions
• Data handling practices
• User experiences
• Communication outcomes

Users access such services at their own risk.

11. Transactions and Disputes

All transactions occur directly between Users and Vendors.

GoKhoj is not responsible for:

• Product quality
• Product authenticity
• Pricing disputes
• Delivery disputes
• Refund disputes
• Payment disputes
• Warranty claims
• Service quality

Any disputes arising between Users and Vendors must be resolved directly between the concerned parties.

GoKhoj may review complaints but is under no obligation to intervene or resolve disputes.

12. Account Suspension, Removal, and Termination

GoKhoj reserves the absolute right, at its sole discretion, to:

• Suspend accounts
• Restrict access
• Remove listings
• Remove advertisements
• Disable features
• Terminate accounts permanently

with or without notice.

Such action may be taken for reasons including but not limited to:

• Violation of these Terms
• Legal compliance requirements
• Fraudulent activity
• Security concerns
• Misleading information
• Platform abuse
• Complaints received
• Operational reasons
• Business reasons
• Technical reasons

GoKhoj is not obligated to provide:

• Prior notice
• Warnings
• Explanations
• Compensation
• Refunds

The decision of GoKhoj shall be final and binding.

13. Intellectual Property

All Platform content including:

• Logos
• Branding
• Designs
• Software
• Text
• Graphics
• Platform functionality

belongs to GoKhoj or its licensors.

Vendors grant GoKhoj a non-exclusive, royalty-free license to display, reproduce, promote, and distribute listings, shop information, images, and related content for the operation and promotion of the Platform.

14. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis.

GoKhoj makes no warranties regarding:

• Accuracy of listings
• Vendor conduct
• Product quality
• Availability of services
• Continuous operation
• Business outcomes

GoKhoj does not guarantee:

• Sales
• Revenue
• Leads
• Customer inquiries
• Visibility outcomes
• Search rankings
• Business growth

15. Limitation of Liability

To the maximum extent permitted by law, GoKhoj shall not be liable for:

• Direct losses
• Indirect losses
• Incidental damages
• Consequential damages
• Business losses
• Revenue losses
• Reputational losses
• Data losses

arising from:

• Platform usage
• Vendor activities
• User activities
• Transactions
• Third-party services
• Promotional services

16. Privacy

Use of the Platform is also governed by the GoKhoj Privacy Policy.

Users and Vendors are encouraged to review the Privacy Policy before using the Platform.

17. Modifications to Terms

GoKhoj reserves the right to modify these Terms at any time.

Updated Terms become effective upon publication on the Platform.

Continued use of the Platform constitutes acceptance of the revised Terms.

18. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts having jurisdiction over the location of GoKhoj's principal place of business.
